Who qualifies?

You are eligible to claim from the Road Accident Fund in the following cases:

If you were injured in the accident that you didn’t cause. If you are only partially responsible for the accident, you can still lodge a claim, but you will only be eligible for partial compensation.

If you are a dependent or a close relative of the deceased, who had to cover the funeral costs of the deceased.

If you were involved in the accident as a driver, passenger or pedestrian.

If you were merely the driver of the vehicle and the accident was due to the owner’s negligence (e.g. he didn’t maintain the vehicle properly.)

Unfortunately you cannot claim in the following scenarios:

When you caused the accident.

If you were the only person and vehicle involved in the accident (e.g. you drove into a wall).

Process

When you call Nothnagel Attorneys, we will arrange a meeting with you to assess your situation and gather as much information as possible.

Once we have built your case, we lodge your claim with the RAF, who then has up to 6 months to investigate the claim.

If the RAF doesn't respond in your favour, we serve a summons and prepare for a court date, where we will oppose their decisions.

Fees

We will fully disclose for which costs you will be billed.

During the legal process we carry the costs relating to your claim, so as not to burden you with any administrative fees. The Road Accident Fund, on finalisation of the matter, will cover most of the costs you have incurred with us.
